Model Release Forms / Vouchers - It is essential that a copy of the model release form is emailed to booker prior to the scheduled shoot. Models will not sign release forms without consent from the booker. We no longer use vouchers; instead request you confirm model arrival with Name of Model and Time of Arrival and Finish Time via text message.

Rates - Rates are applicable to booking time only; all usage must be negotiated through the agency. Preparation time, make-up and hair dressing time is charged at full time fee unless included in the booking time.

BOOKINGS

Hourly Booking - 2 hour minimum at model's hourly fee; length of the job must be specified at time of booking.

Day Booking - Day bookings are computed on an eight consecutive hour day basis between 9 am and 5.00 pm / unless arrangements have been negotiated with agency; meals and water are to be provided on all 8hr bookings.

Over-Time Rates - Over-time rates are time and one half and apply before 9 am and after 5.00 pm and also on Saturdays, Sundays and holidays unless negotiations have been made with the agency.

Fitting & Wardrobe - A full rate will apply with 1/2 hour minimum.

Travel Time - Will be charged at one and one half.

Rehearsal Time - A full negotiated rate.

Lingerie & Underwear - Bras, pantyhose, brief, transparent, or transparent articles, as well as men's shorts and briefs, are double rate. Two hour minimum. Agency must check with model before accepting any risqué bookings.

Experimental, Spec. Job, Test Shooting - Photographers may not use pictures commercially. Test photos are to be used by model, agency and photographer for self marketing. models may not sign releases for test shootings.

Video and Film - All bookings involving video and motion picture film must be negotiated separately in advance.

Electronic Media & Internet Use - Are subject to negotiation prior to booking.

Product Bookings - Are subject to prior negotiation with the agency. Consumer product packages, posters, billboards, point of purchase, display or the use of the model's name must be specifically cleared with the agency.

Cancellations - If a booking is cancelled within three working days of the starting time the full fee will be charged. If a booking is cancelled outside of the three day period but within five working days of the starting time, 50% of the fee will be charged. With cancellations or alterations relating to events, Clients will be required to cover all costs incurred by xposureOMM up to the cancellation date and an Agency Fee of 20%.

Weather Permits - If a booking is ‘weather permitting’ this must be made clear at the time of booking. At the first cancellation, half the fee is charged unless the client fails to cancel in time to prevent the models from leaving their location or attendance, in this situation the full fee is payable. At the second cancellation the full fee is charged.

Service Charge - Agency fees are negotiated at time of booking. We require payment before scheduled shoot with all clients. Contract projects require payment within 20days from the shoot/show date. All promotional projects are paid as agreed. A $20.00 NSF charge will apply to each any check that does not clear and a 2% finance charge per day until invoice is paid. Any invoice outstanding 30days are subject to an 18% finance charge.

Insurance - The agent is not responsible if the model fails to attend the booking. While a replacement or refund will be offered, the client is advised to insure against any loss which might result if the model does not keep a booking because of ill health or some other reason.

Law - These terms and conditions and the contract between Agency and Client governed by these terms and conditions shall be governed by State of Colorado and the parties agree to submit to the exclusive jurisdiction of the Colorado Courts.

Financial - Client agrees to keep all financial issues strictly confidential and agrees to only discuss rates with the Agency. No rates are to be negotiated with the model[s]

RESTRICTIONS ON DIRECT ENGAGEMENT OF THE AGENCIES MODELS - Client agrees not to directly employ Agency’s Models within one [1] year of the last day of the booking. If the Client does employ or engage Agency Models, Client will be liable to pay Agency a commission at its then current rates.
